The use of Topmed AG's range of services (hereinafter”operators“,”we“,”us“,”ours“) on the EnMedify platform (https://www.enmedify.ch) (hereinafter:”platform“) by the user (hereinafter also”you“,”Yours“,”yours“) is subject to the following general terms and conditions (hereinafter”TERMS AND CONDITIONS“).
The platform is aimed at users from Switzerland and was developed in accordance with the principles of Swiss law. Unless otherwise stated, the use of the platform and the services offered on it is limited to Swiss territory.
Our platform enables patients to book appointments with doctors with expertise in treatment with medical cannabis, use online services from doctors (telemedicine), communicate with pharmacies and redeem prescriptions.
Before using the platform, you are required to create a user account and read these terms and conditions as well as our Privacy statement, which forms an integral part of the terms and conditions. By setting up a user account and accessing the platform, the user declares to have understood and accepted the present conditions and legal information. If you do not agree with these terms, you must refrain from using the platform and the services offered on it.
Conflicting or deviating conditions of the users do not apply, even if the operator does not separately object to the validity of these in individual cases. The operator's terms and conditions also apply if services related to the platform (e.g. telemedicine services by our partner doctors) are provided without reservation in the knowledge of conditions that conflict with or deviate from these provisions. Individual written agreements made with users in individual cases nevertheless prevail over the terms and conditions in any case.
The following services are currently offered on our platform:
On the platform, the operator provides a telemedicine service for treating patients with medical cannabis. Through the platform, users can get in touch with appropriately specialized medical practices, which are either operated directly by the operator or with whom the operator works on the basis of a written contract and which offer their services via the platform.
Users can either make an appointment on site at the doctor's practice or with the doctor of their choice, or book an online consultation or treatment appointment (telemedicine). Online appointments are carried out via remote treatment/video consultation. The corresponding infrastructure (software, etc.) is provided by the operator via the platform.
If the user wishes to claim medical services and books a corresponding appointment for the first time, a questionnaire is automatically sent to the user via the platform to fill out. This questionnaire was developed by the operator in cooperation with the collaborating doctors and is evaluated by the operator in cooperation with them. The questionnaire must be completed online by the user before the first doctor's appointment (which usually takes place physically in a doctor's practice, unless the evaluation of the questionnaire by the partner doctor would show that the initial appointment can also be easily made via video consultation) and is transmitted via the platform to the selected doctor or doctor's practice. The aim of the questionnaire is to carry out an initial evaluation with regard to the patient's suitability for and experience with the use of cannabis therapy. Users are required to fill out the questionnaire truthfully.
Counseling and treatment services on site and via telemedicine are provided by qualified doctors with whom the operator works. In this case, the operator will exclusively mediating operates and gives users access to the appropriate services. The medical treatment contract is coming directly and exclusively established between the treating doctor or medical practice and the user. The operator has no influence on the treatment and the other services provided by the doctor and cannot be used for this.
The attending physician and the medical staff of the cooperating medical practice act freely and independently with regard to the decision to be made as to whether the use of the telemedicine service by the respective user is justifiable and appropriate in individual cases. Specific medical services are also provided by the cooperating medical practices and doctors in compliance with employment, service and professional obligations.
The brokerage service owed by the operator covers the provision of the infrastructure required as part of the service offering for initiating medical services and establishing contact between the user and the medical staff of the medical practice (e.g. booking an appointment) as well as the video consultation software required to carry out the telemedicine services.
Among other things, the operator also provides pharmacy services on the platform. These services are provided by pharmacists and other qualified pharmacy employees with whom the operator has concluded a written cooperation agreement.
Cooperation with pharmacies allows users of the platform to redeem a prescription, which is issued by the doctor following the video consultation, directly via the platform. In this case, the operator will exclusively mediating operates and gives the user access to the corresponding services. The operator has no influence on the advice and other services provided by the pharmacy (e.g. redemption and storage of prescriptions, mail-order of medicines, etc.) and cannot be used for this purpose.
The pharmacy and the corresponding staff provide their services freely and independently.
The brokerage service owed by the operator includes providing the infrastructure for contacting the pharmacy and transmitting prescriptions to the pharmacy via the platform.
The platform allows users to book medical appointments online (physically or online) and to make these appointments via telemedicine video call (see above).
In addition, doctors can issue prescriptions and connect with cooperating pharmacies via our platform to make it easier for the user to receive prescribed medications quickly.
We reserve the right to adjust the range of services offered at any time. As a user of the platform, so that you remain informed about changes to the range of services offered at any time, we recommend that you sign up for our newsletter (see below).
Before our range of services can be used, the user must register on the platform and comply with these terms and conditions, including Privacy statement, accept.
Registration and use of the platform requires the user to be of legal age, which must be confirmed by providing the date of birth when the user account is created.
Users can here Register by entering your first name, last name, address, email address and date of birth.
Technical access to the platform is the sole responsibility of users. As a user, you are required to take the necessary security measures for your own devices (e.g. computer, tablet, smartphone) from which you access the platform and to protect them from unauthorized access by third parties and from malware. You are also required to keep your user account information, in particular the password, secret and not to allow any third party to access the platform via your user account.
Users are hereby expressly made aware of the security risks associated with the use of the Internet and Internet-based technologies. As the operator of the platform, we make every effort to enable you to use the platform securely and protect it from unauthorised access. However, we cannot guarantee that the platform and the corresponding services will be available to you at all times and uninterrupted, nor that Internet-based services such as the services provided by us are 100% secure.
Users are required to keep the platform and the corresponding software (e.g. for video consultations) up to date and to carry out updates. There is no right to use a specific version of the platform. Any costs for network access in order to be able to use the platform and the services offered on it are borne by the user.
Every user is obliged to check the data entered by him/her for completeness and accuracy. Users are responsible for all personal data that is entered and stored via the platform (see also our privacy policy).
As a user, you are then required to comply with the following rules of conduct:
1. to answer the questionnaire sent truthfully and completely with questions about the state of health; 2. to create appropriate conditions (brightness, peace, technical requirements) for remote medical treatment/telemedicine advice; 3. not to disseminate prohibited, disparaging, insulting, violence-glorifying, infringing and/or pornographic content via the platform.
In the event of violation of the above obligations or misuse, the operator reserves the right to immediately block the user's access to the platform or the corresponding user account and not to provide any further services to the user. All other rights to which the operator is entitled under contract or applicable law are expressly reserved.
Physicians, pharmacists and their assistants are subject to medical confidentiality. In order for us to be able to provide you with the services mentioned above, which include arranging telemedicine consultations, submitting the questionnaire about your state of health, billing or collection of medical services and making appointments, it is necessary that you release the treating doctors, pharmacists and their assistants from the obligation of confidentiality to us to the extent that this is necessary to provide the services by us via our platform. The scope of this release, as well as further information on how we process your data, is set out in our Privacy statement regulated.
BY ACCEPTING OUR PRIVACY POLICY, WHICH FORMS AN INTEGRAL PART OF THESE TERMS AND CONDITIONS, YOU RELEASE YOUR TREATING DOCTORS, PHARMACISTS AND THEIR ASSISTANTS FROM MEDICAL CONFIDENTIALITY VIS-À-VIS US INSOFAR AS THIS IS NECESSARY FOR THE PROVISION OF SERVICES BY US VIA THE PLATFORM.
We are committed to always keeping your personal data and, in particular, your health data extremely confidential and will not share it with third parties without your consent.
The medical services are billed by the medical practice or the attending physician based on agreed Flat rates or the tariffs applicable in Switzerland. Invoicing takes place immediately after a billable service has been carried out. Payment is processed via the platform or by the operator as a collection service provider. For this purpose, the user must provide appropriate information about the means of payment (e.g. billing address, credit card) upon registration.
Users themselves are responsible for checking with their health insurance company whether the medical services are covered in full or in part and to reclaim the paid services from their health insurance company.
The costs for the initial consultation are regularly CHF 99.—.
Should it be determined during the initial consultation that cannabis therapy is not medically indicated, the fee can be refunded on a goodwill basis. The decision on medical suitability lies exclusively with the attending physician. The warranty does not guarantee success or the assurance of a prescription.
Appointments for medical services can be booked by users up to 24 hours cancel or rebook free of charge before the scheduled date. The cancellation/rebooking can be made directly via the appointment planner on the platform.
If an appointment is not kept or cancelled or rebooked within less than 24 hours, the user will be charged the full amount of the appointment.
The benefits statement and payment of medicines are made directly through the pharmacy.
Users themselves are responsible for checking with their health insurance company whether these services or the costs of the prescribed medication are covered in full or in part and to recover the corresponding amounts from their health insurance company.
The remaining services (e.g. information and content provided on the platform, use of the software for video consultations, online appointment booking, etc.) are made available to users free of charge.
All rights to the content published on the platform and the associated applications, in particular the copyrights, belong to the operator or the specifically named rights holders or have been licensed to the operator.
The content published on the platform may only be used by users for their own use. Any further reproduction and transfer of the content to third parties is prohibited. Downloading or copying content, images, photos or other files does not transfer any rights to the content.

The operator's liability for services provided by us is governed by legal regulations. Any liability claims against the operator for damage, including subsequent damage of a material or immaterial nature, arising, for example, from access to or use of the platform and its information, content and messages as well as services, from misuse of the connection, from technical faults or from violation of the user's duty of care, are excluded to the extent permitted by law. In particular, any liability for indirect damage, in particular subsequent damage suffered by users as a result of using the platform or in the course of providing our services, is excluded to the extent permitted by law. The exclusion of liability does not apply to damage due to intent or gross negligence.
Liability for assistants and third parties is excluded to the extent permitted by law.
The operator assumes no responsibility and does not guarantee that the functions and use of the platform are available continuously and uninterrupted, are error-free or fault-free or that errors will be corrected, or that the servers and software are free of viruses or other harmful components.
The operator is entitled to interrupt or discontinue use of the platform at any time.
Although the operator takes every care to ensure the accuracy of the content and messages on the platform, no liability or warranty can be assumed with regard to their correctness, accuracy, timeliness, reliability and completeness. The operator expressly reserves the right to change, delete or temporarily refrain from publishing information and content in whole or in part at any time without notice.
Any action or omission based on information, content or messages on the platform is the sole responsibility of the user and at their own risk. The operator assumes no liability for any resulting damage. Accordingly, the platform does not provide recommendations for actions, omissions, or instructions for conduct. In particular, the operator and the platform do not make any medical assessment and do not recommend any treatment and/or the taking of certain measures.
References and links to third-party websites are outside the operator's area of responsibility. The operator assumes no liability for the existence, content or accuracy of this information. Access and use of such websites is at the user's own risk. The operator expressly declares that he has no influence on the design, content and offers of the linked pages. Information and services from linked websites are entirely the responsibility of the respective third party. Any responsibility for such websites/links is denied.
The operator is not liable for the provision of services by third parties, in particular for services provided by partner medical practices, partner doctors and partner pharmacies (including their staff) and their vicarious agents. Corresponding claims must be made directly against these third parties.
The use of the platform and the corresponding services is voluntary. Users can freely decide to stop using the platform and/or the corresponding services at any time.
If you wish to cancel with deletion of the user account, this can be sent via e-mail to support@enmedify.ch be applied for. Please note that we will only delete your user account once all outstanding payments have been paid in full. In addition, we will continue to store your data for archiving purposes until the legal deadlines have expired (see also our privacy policy). If you would like an electronic copy of your data in advance, you can also request this by sending an e-mail to the above address. When you delete your user account, your right to use the platform, its content and the services offered on it ends.
The operator reserves the right to suspend or cancel the user account or the user's access to the platform at any time and for any reason, temporarily or permanently, including if the user fails to comply with these terms and conditions or to carry out maintenance work on the platform. The operator can decide to stop providing the platform and the corresponding services at any time. In such a case, users will be notified in advance and reimbursed for services that have already been paid for but not used.
The operator can change these terms and conditions at any time, in particular taking into account the legal, legislative, jurisprudential and/or technical developments. The latest version is the one that is available online at the following address: https://www.enmedify.ch/agb/. The user is expressly informed that the only binding version of the terms and conditions is the one that can be found online on the website, with which the user fully agrees. By continuing to use the platform following such changes, the user agrees to the new terms and conditions. Important changes to the terms and conditions will be notified to the user separately and 10 days before they come into force.
Swiss law is exclusively applicable to all disputes arising from or in connection with a contract concluded on the basis of these terms and conditions. To the extent permitted by law, the courts at the registered office of the operator (currently: Freienbach SZ, Switzerland) are exclusively responsible for all disputes arising from or in connection with these terms and conditions or the application.
